All orders are subject to Cactus Juice’s approval and may be denied for ANY REASON. If an order is denied a full refund will be issued.

Pricing and Payment Policy

Reseller agrees that it will not sell Cactus Juice products for less than 20 percent below Cactus Juice MSRP without Cactus Juice prior written consent.

Current MSRP are the prices listed on our website.

Cactus Juice reserves the right to change their pricing at any time without prior notice you.

Goods are shipped when full payment is received unless prior arrangement has been made.

All goods remain the property of Prickly Pear Skin Care LLC and are protected under the Intellectual Property Laws.

Cactus Juice reserves the right to terminate the account of any Reseller who, in Cactus Juice‘s sole opinion, diminishes Cactus Juice‘s brand or image because of the way Products are sold, priced, serviced, depicted or represented.

***Online Sales***

Selling Cactus Juice products online is not allowed. Reseller agrees that it will NOT engage (directly or indirectly) in any sales of Cactus Juice‘s products on eBay, Amazon or ANY other auction or similar group buying and/or discount websites.

In addition to any other remedies Cactus Juice may have, Reseller authorizes Cactus Juice to retroactively charge Reseller the difference between the wholesale price paid and the retail MSRP, plus applicable taxes, FOR ALL ITEMS PURCHASED if it is determined that Reseller is engaging in unauthorized online sales of Cactus Juice products OR IF RESELLER IS PARTY TO UNAUTHORIZED SALES.

If the Retailer is planning to sell Cactus Juice in an online marketplace/store, it must be owned or operated by the entity applying for a Wholesale Account and listed on the Wholesale Application. The online store must abide by strict MAP pricing guidelines.

Shipping and Insurance

Orders are generally shipped via USPS Priority Mail, or UPS and will arrive 1-7 business days from shipping date for all domestic orders.

Inspection and Acceptance

You will notify us in writing of any shortage, nonconformity or defect or other claim within 72 hours after delivery of the Product(s), otherwise you will be deemed to have accepted the Product(s) and waive any rights to reject them.

Terms of Termination

These terms and conditions are applicable to you upon your accessing this site and/or placing an order. These terms and conditions, or any part of them, may be terminated by Cactus Juice without notice at any time, for any reason. The provisions relating to, Trademark, Limitation of Liability, and Miscellaneous, shall survive any termination.

Miscellaneous

Your use of this site shall be governed in all respects by the laws of the state of Texas, U.S.A. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Cactus Juice products) shall be in the state or federal courts located in Collin County, Texas.

Cactus Juice’s failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Cactus Juice may assign its rights and duties under this Agreement to any party at any time without notice to you.

Limitation of Liability

RESELLER AGREES THAT Cactus Juice  SHALL NOT BE LIABLE BEYOND THE REMEDIES SET FORTH HEREIN.

Changes to these Terms and Conditions

Cactus Juice reserves the right to amend its terms and conditions from time to time with such amendments to apply to all orders received on or after the time of posting the amendments on Cactus Juice's Internet website.
